Cary McClain is a trial lawyer-  This means  he has spent his career in the courtroom presenting cases and cross-examining witnesses. “Trying cases is an art, not a science. Attorney McClain is interviewed and consulted by news media regarding high profile cases. He has litigated and won suppression motions for pounds of marijuana and pounds of cocaine. He has saved clients from the death penalty and secured not guilty verdicts for first degree murder. 

A tough prosecutor – Mr. McClain began his courtroom career in the Philadelphia and Montgomery County District Attorney’s Offices.   As a prosecutor in the 1990’s, he worked on the Major Crimes Unit, Narcotics Enforcement Team, and Homicide Unit trying dozens of cases involving murder, armed robbery, drug distribution, DUI and Homicide by DUI to name a few.  He has extensive trial experience prosecuting and defending cases that involve death by motor vehicle and DUI utilizing accident reconstruction and expert testimony to prove the case.

A veteran civil trial lawyer- After his tenure as a prosecutor, Mr. McClain became a Senior Trial Attorney for a large Insurance Company and supervised their Special Investigations Unit.  In his five years with the Insurance Company, Mr. McClain tried more than 60 civil personal injury auto accident and slip/fall jury trials to verdict in Philadelphia, Montgomery, Delaware, Bucks and Chester counties. Many of the cases involved car accidents with injuries ranging from neck and back herniated discs, surgery, injections, shoulder injuries, concussions, broken bones, carpal tunnel, lacerations and scarring.

David Downey, Esquire

David is a solo-practitioner, but assists as an independent contractor on McClain Firm cases. He has almost two decades of experience in residential real estate lending, investing, and venture capital. In 2001, David graduated from Temple University with a Bachelor of Arts in Business Law and Marketing. He navigated his way through the ever-changing lending market including the 2008 Housing Market Crash. In 2012, David enrolled in an evening program at Delaware Law. While in law school, David raised capital for business ventures, including Stateside Vodka.  He works on a variety of cases including business ventures, real estate matters, family law, criminal defense, and personal injury with a focus on car accidents.  Of note, David settled a malpractice case involving a patient who was diagnosed with pneumothorax from an acupuncture and cupping incident. David is a member of the Pennsylvania Bar Association, Montgomery County Bar Association, and Philadelphia Bar Association. He is an Arbitrator for civil litigation cases in Montgomery County.


Robert Abernethy

Robert is a 2014 graduate of Saint Joseph’s University and a 2018 graduate of the Thomas R. Kline School of Law at Drexel University in Philadelphia, where he focused on trial advocacy: competing with Drexel Law’s #4 nationally ranked trial team; working for the Delaware County District Attorney’s Office as a certified legal intern; volunteering service for the Pennsylvania Innocence Project; and working in a co-op position assisting with the representation of victims of sexual assault and child abuse in civil litigation. Robert is a private contractor consultant on the The McClain Firm team focusing on Personal Injury and Criminal Defense cases. He is also our resident “Law Tech” guru.
